General terms and conditions of business
1. General Terms of Business
The freelance business of LINARKEO is subject to French law
and therefore free of tax (art. 293 B). All prices are in
Euro and before VAT.
The following general terms and conditions of business apply
to all business dealings between LINARKEO and the customer.
By placing an order the customer recognizes these terms and
conditions. They apply to the entire period of the business
relationship.
2. Prices and fees
Prices are found in the price list.
The rates for translations are based on the number of words
in the original document. They vary depending on the grade
of difficulty and the nature of the text as well as on the
urgency of the order.
Translations will, if possible, reflect the layout and
pagination of the source text. Special request shall be
communicated in writing and may be subject to additional
fees.
Interpreting work is based on hourly or daily rates.
Additional fees (travelling dispenses, overnight stays and
lunch) are invoiced to the customer.
All other services will be based on hourly rates.
3. Delivery
The place of fulfilment is the domicile of LINARKEO. If the
customer requests translations or other services to be
dispatched, this will be by e-mail (no express post, no
registered mail). Any other forms of delivery shall be
agreed upon in writing. Any postal fees except e-mail are
invoiced and are in charge of the customer.
4. Payment conditions
The order is only executed on the basis of a written offer.
To confirm an order, the client shall return the signed
estimate with an advance amounting of 50% of the total cost,
net of tax.
The complete payment has to be done at the reception of the
order or at agreed individual conditions.
5. Delivery deadline
Prompt delivery to agreed deadlines is guaranteed. LINARKEO
accepts no liability for delays due to fax or modem
transmission problems or other communications enterprises.
6. Property rights and copyright
Translations shall be the intellectual property of LINARKEO
(§ L132-11 of the French law). The multiple use thereof
shall be subject to the consent of LINARKEO. The name of the
translator shall be mentioned.
7. Warranty
LINARKEO shall not be responsible for translation errors
caused by illegible, faulty or incomplete source texts, the
customer’s own terminology or by the absence of contexts.
Any issues relating to questions of style shall also be
excluded from liability. In the event of translation errors
for which LINARKEO is responsible, the customer’s warranty
claims shall be limited to the right of subsequent
improvement. The customer shall submit its request for
subsequent improvement to LINARKEO in writing, including a
full statement of the defects to be remedied within two
weeks following delivery of the translation.
8. Place of jurisdiction
The place of jurisdiction is Nantes (France). All
contractual agreements are subject to French law only. |
